Los Angeles And Orange County Disability Insurance And ERISA Claim Attorneys Fight Prudential Claim Denials

At McKennon Law Group PC, we aggressively exhaust all avenues to pursue your right to receive benefits from life and disability insurers like Prudential, in part, because we know insurers like Prudential. McKennon Law Group PC’s founder, Robert J. McKennon, represented Prudential and other such insurance companies in the past, which is part of the reason why we are to settle so many claims prior to litigation.

Prudential is one of the largest insurers in the U.S. and operates across the world in Asia, Europe and Latin America. Prudential provides a variety of products, as well as services, including life insurance, annuities, retirement-related services, mutual funds and investment management. Prudential has been in business for over 140 years, and was first founded by an insurance agent named John Fairfield Dryden in 1875. Interestingly, Prudential’s logo is accompanied by an image of the Rock of Gibraltar, a large limestone monolith located in the Mediterranean Sea southwest of Spain. Prudential is a major player in the group disability and group life insurance field, issuing long-term and short-term disability policies, life insurance and accidental death and dismemberment insurance. Prudential has a reputation for aggressively denying life and disability insurance claims, and we see them often when our clients hire us to fight Prudential’s claim denials.

Prudential issues insurance products through several companies.

Depending on location, you may be dealing with one of Prudential’s subsidiaries. Prudential’s insurance products are issued by several companies, which vary based on the state and type of product the subsidiary is licensed to sell. Pruco Life Insurance Company (Pruco) is an Arizona company that is licensed to sell life insurance and annuities in all states, except New York. In contrast, both Pruco Life Insurance Company of New Jersey (Pruco New Jersey) and The Prudential Insurance Company of America (Prudential of America) are licensed in New Jersey. However, Pruco New Jersey can only sell life and annuities in New Jersey and New York, whereas Prudential of America is licensed to sell life and annuities in all states, including California. The Prudential Annuities Life Assurance Corporation is a Connecticut company licensed to sell only annuities, but in all states.

How Does Prudential Deny Life And Disability Insurance Claims?

Prudential denies claims based on many reasons including, but not limited to, the following:

  • Prudential asserts the evidence does not support the life or disability claim
  • Prudential asserts the claimant did not provide adequate medical support for the life or disability claim
  • Prudential asserts the claimant did not provide documentation or proof of loss evidence in a timely manner
  • Prudential asserts the condition which is the subject of the claim is a pre-existing condition
  • Prudential asserts the insurance application contained materially false information, and thus the policy can be rescinded
  • Prudential asserts surveillance of the claimant suggests that the claimant is not totally disabled
  • Prudential asserts the claimant’s policy has lapsed for failure to pay premiums
  • Prudential asserts an exclusion in the life or disability policy precludes coverage for the claim

What Should Disability Or Life Insurance Claimants Look For When Prudential Denies A Claim?

  • Prudential improperly investigating the claim
  • Prudential improperly obtaining opinions from unqualified persons/supposed experts
  • Prudential improperly misreading or misinterpreting medical records
  • Prudential improperly hiring and using biased “independent” medical reviewers and examiners
  • Prudential improperly denying a claim without any medical examination
  • Prudential improperly refusing to acknowledge subjective disabling conditions such as mental disorders, autoimmune disorders, fibromyalgia and chronic fatigue syndrome because there is no objective evidence of the condition
  • Prudential improperly asserting a preexisting condition
  • Prudential improperly attempting to rescind the policy
  • Prudential improperly denying a claim with the intent to wear the claimant down to a lower settlement
  • Prudential improperly over-relying on surveillance evidence to conclude a claimant can work
  • Prudential improperly over-relying on social media evidence to conclude a claimant can work
  • Prudential improperly failing to have a meaningful dialogue with the claimant
  • Prudential improperly failing to use findings by the Social Security Administration to support a disability claim

If you feel you have a wrongfully denied claim for disability, life or other insurance involving Prudential, the McKennon Law Group PC will be dedicated to the pursuit of your benefits.

Having an aggressive and experienced disability, health and life insurance litigation attorney is the most important decision you can make for the success of your insurance claim. If your claim for health, life, accidental death or dismemberment, short-term disability or long-term disability insurance has been wrongfully denied or suddenly terminated, fill out a free consultation form or call 1-800-682-4137 to schedule a free consultation with the attorneys of the McKennon Law Group PC, several of whom previously represented insurance companies and are exceptionally experienced in handling ERISA and non-ERISA, bad faith insurance claims.
