Employee Retirement Income Security Act (ERISA)
Most of the life, health and disability policies issued through employers in the United States are governed by the Employee Retirement Income Security Act (“ERISA”) (see the “FAQs” section of our website for more information on ERISA). As to the policies governed by ERISA, a policyholder can sue for policy benefits, attorneys’ fees and interest due on the benefits not paid. ERISA is a very complex area of the law and it is important you have an attorney that understands it. ERISA claims are the most frequently cases litigated in Federal Court, a court in which most lawyers are uncomfortable. ERISA involves mandatory administrative appeals and it is imperative that you know your rights and that you hire an attorney early in the process after your claim has been denied and before your appeal is administered. It is also imperative that this appeal procedure is correctly followed and prosecuted. If it is not, you will likely lose your right to sue your employer and/or the insurance company that administers the claim.
We have had extensive experience litigating ERISA and insurance bad faith cases involving life, health and disability claims. No attorneys in California are better situated than we are to litigate your insurance claims. We can and will aggressively litigate your case to achieve maximum success.
